1. The parties advised they had reached agreement in principle as to the resolution of this appeal and other litigation that was before the Court relating to this matter.

2. The settlement required a detailed easement to be agreed and signed. Before this could be achieved engineering advice was required of which need engineering advice.

3. The parties are confident they will resolve the matter by the end of April.

4. At the request of the parties we adjourn this appeal to the next session.
